You should store your javascript using a skin directory. It's always good to
be able to customize ttw your javascript.

But it doesn't solve the question. Yes you can do it that way, or by
checking if the request implements the layer. But except if you want to do a
theme switcher, the theme is not supposed to change in the normal website
lifecycle.
